“Pioneer & Beyond Limited” acts under the UK legislation, including the UK Data Protection Act 2018 (DPA 2018), and basing on the EU General Data Protection Regulation (GDPR) which has been implemented into UK legislation and can be referred to as UK GDPR. We determine the purposes and the manner in which your personal data is to be processed.

This Privacy Notice makes you[1] aware of how and why your personal data will be used for purposes of the recruitment exercise, employment placement including explanation of your rights and how long it will usually be retained for.

We collect and hold the following types of personal information:

  1. Personal details, including any information that identifies the data subject and their personal characteristics, including: name, address, contact details, age, date of birth, sex, and physical description.
  2. Personal details issued as an identifier by a public authority, including passport details, national insurance numbers, identity card numbers, driving license details.
  3. Education and training details, including information which relates to education and any professional training of the data subject, including academic records, qualifications, skills, training records, professional expertise, student and pupil records.
  4. Employment details, including information relating to the employment of the data subject, including employment and career history, recruitment and termination details, attendance records, health[2] and safety records, performance appraisals, training records, and security records.
  5. Personal data relating to criminal convictions and offences available online at Disclosure and Barring Service.

We collect personal information about you from the following sources:

  1. yourself, based on your emails that you send to us;
  2. recruitment websites, from which we collect the following categories of data: CVs, covering letters, other formatted related information;
  3. the following data from third parties is from a publicly accessible source: e.g. LinkedIn data.

Most of the personal information we process is provided to us directly by you for one of the following reasons:

  • You have requested us to help you find a job in China or another country.
  • You have made an enquiry or complaint to us.

Under data protection legislation, you have rights including:

Right of access – You have the right to ask us for copies of your personal information.

Your right to rectification – You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.

Your right to erasure – You have the right to ask us to erase your personal information in certain circumstances.

Your right to restriction of processing – You have the right to ask us to restrict the processing of your information in certain circumstances.

Your right to object to processing – You have the the right to object to the processing of your personal data in certain circumstances.

Your right to data portability – You have the right to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have 28 (twenty eight days) to respond to you.

We contact you and ask if you wish to teach in China or another country. We collect your data, if you agree that we help you to find a job for you in China or another country. 

If we find that your CV corresponds with our job requirements, but without a written intention to teach in China or another country on one of the recruitment websites, we may contact you to ask if you wish to teach in China or another country. We only collect your data, if you agree that we can help you to find a job in China or another country. Any information that we may retain is securely encrypted.

We need to collect your private information, as mentioned in this Privacy Notice, in order to help you to sign a contract with an Employer, to establish if it is possible for you to obtain a visa and because we have a legal and contractual obligation to do so.

We act under the UK legislation, including the UK Data Protection Act 2018 (DPA 2018) and Regulations that originate from the EU (the EU General Data Protection Regulation).

We use your data in ways you would reasonably expect and only upon your request we only collect information which has a minimal privacy impact. 

We collect your personal data for specified, explicit and legitimate purposes and do not further process data in a manner that is incompatible with those purposes, complying with  the UK GPDR, namely, subparagraph (b) paragraph 1 Article 5 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (Regulations that originate from the EU). 

Legitimate Interest 

This lawful basis is mentioned in subparagraph (f) paragraph 1 Article 6 of the UK GDPR, which allows us to process your personal data when this is necessary to perform our tasks in order to help you to find a job offer for you in China or another country. We have a legitimate interest in contacting you through your publicly available data, since we have a real job opportunity for you. 

Consent 

We shall rely on your consent when there is a purpose of sharing your CV with partners outside UK. For example, China, Vietnam, Philippines have different data protection standards which do not contain rules that would protect an individual from harm or damage as it is understood by UK GDPR. There are possible risks in such international transfers. That’s why we shall ask for your consent if you agree to such transfer. If you explicitly consented to the proposed transfer, after having been informed of the possible risks of such transfers by us, we can transfer your CV outside of the UK then. 

When your consent is required, we will clearly indicate this. You have the right to withdraw your consent at any time. You can withdraw your consent by simply writing to our email, which is; contact@pioneerbeyond.com 

When you do so, we shall cease to process such data. 

You have the right to withdraw your consent at any time. Where consent is the only legal basis for processing, we will cease to process data after consent is withdrawn. 

The processing of your data is necessary to fulfil a contract 

We may process your data if processing of your data is necessary for the performance of a contract to which you are a party or in order to take steps at your request prior to entering into a contract; 

A transfer of your data outside UK shall take place if it is necessary for the conclusion or performance of a contract concluded in your interests between us and another individual, or entity/organisation. 

The processing is necessary for performing obligations in connection with employment 

If we process data concerning health (special categories of personal data[3])  we rely on subparagraph (b) paragraph 2 article 9 of the UK GDPR and Schedule 1 of the DPA 2018, since the processing of your personal data is necessary for the purposes of performing or exercising obligations or rights which are imposed or conferred by law on the data subject in connection with employment. 

The lawful basis we rely on to process your criminal conviction personal data is a legitimate interest (subparagraph (f) paragraph 1 Article 6 of the UK GDPR). We also rely on article 10 of the GDPR and Schedule 1 of the DPA 2018, since the processing of your personal data is necessary for the purposes of performing or exercising obligations or rights which are imposed or conferred by law on the data subject in connection with employment. 

We shall stop any further processing of personal data if we do not get an instruction from you to seek an employment opportunity for you, or if it looks like it may be used in a manner that is incompatible with the original purposes. 

After you have submitted your private information to us, we take the following actions:

  • evaluate your professional expertise and competence, degree level, qualifications, and overall suitability for the job in China or another country based on your submitted private information;
  • interview you within the recruitment process;
  • keep records of undergoing processing steps;
  • comply with UK legislation.

It is in our legitimate interest to decide whether to give your application to the Employer in China or another country, because it is beneficial to our Company to support you from the initial interview until they receive a job in in China or another country.

We will invite you for an interview if your application is suitable for fulfilling a job in China or another country.  

After the interview, if we decide that your application is suitable, we will assess the information that you have supplied, offer your details anonymously to a possible employer. If you accept an offer from the Employer and sign a contract, we will further process your documentation by ensuring you have your documentation legalised before finalising the legal requirements for a work visa.

In this concern, your private data will be transferred to a recipient outside the UK and will be received by the Employer.

The personal data transferred may be disclosed only to the following recipients or categories of recipients: Education and Childcare, we do not sell your data, or make it available to advertisers.

We transfer only the data that is necessary for making your job application to the Chinese Employer or an Employer in another country for the purpose of employment.

A Chinese Employer or an Employer in another country outside the UK shall sign Standard Contractual Clauses with us as required by the UK GDPR where applicable.

However, China and other countries outside the UK, where your personal data may go, may have different data protection standards. But the transfer of your personal data specified in our Privacy Notice is necessary for the conclusion or performance of a contract concluded in your interests between you and an Employer.

We do not and we will not share your personal information with any third parties for the purposes of direct marketing.

Your information is securely stored by “Pioneer & Beyond Ltd.” with appropriate technical and organisational security.

We keep your information for the minimum amount of time required in order to be able to process:

  • evaluation of your professional expertise and competence, degree level, qualifications, and overall suitability for the job in China or another country based on your submitted private information;
  • interviewing you.

We intend to keep your information for the shortest period possible and not more than three years. We will then dispose of your information by removing it from the storage drive (no hard copies are kept). It will be deleted irretrievably.

If you see that we provide links to websites of other organisations, it should be clear, that this Privacy Notice does not cover how those organizations process personal information under the GDPR.

We advise you to read carefully the privacy notices on the other websites that you visit.

We are not obliged to provide you with the Privacy Notice where and insofar as you already have  the information.

When obtaining personal data from other sources rather than from you directly, we have no obligation to provide individuals with the Privacy Notice if:

  • the individual already has the information;
  • providing the information to the individual would be impossible;
  • providing the information to the individual would involve a disproportionate effort;
  • providing the information to the individual would render impossible or seriously impair the achievement of the objectives of the processing;
  • we are required by law to obtain or disclose the personal data; or
  • you are subject to an obligation of professional secrecy regulated by law that covers the personal data.

We do not provide services directly to children or juveniles. We do not collect personal information of children or juveniles.

We process personal information of adults. Age range is in accordance with the requirements for a work visa in China or another country.

We have responsibilities under equality and diversity legislation and maintain high standards when dealing with our customers. 

However, if a customer is behaving in a difficult manner, or is overly persistent in contacting us, or acts in an unacceptable manner, we will consider whether this may be making our services too complex to be accessed.

We shall communicate any rectification or erasure of personal data or restriction of processing carried out in accordance with the GDPR to each recipient to whom the personal data has been disclosed, unless this proves impossible or involves disproportionate effort.

We keep our Privacy Notice under regular review to make sure it is up to date and accurate.
